Terms and Conditions


By entering the “Quay SPIN THE WHEEL AT THE AUSTRALIAN OPEN” promotion, you agree to the following terms and conditions:



1.1.  The “Quay Spin the Wheel at the Australian Open” (“Promotion”) is conducted by Quay Eyeware Pty Ltd (ABN 74 118 078 274) (“Promoter”) of 58 Gipps Street, Collingwood 3066].


1.2. Information on how to enter the Promotion and prize details set out in all communications regarding the Promotion form part of these Terms and Conditions. By entering into the Promotion, you accept these Terms and Conditions.


1.3. Unless otherwise indicated, all times and dates specified in these Terms and Conditions are times and dates in Melbourne, Victoria, Australia, which may be in the time zones AEST or AEDT depending on the date.




2.1. Entry is open to Australian residents who:


2.1.1. are visitors of the Australian Open held from 17 January 2022 to 30 January 2022 (inclusive);

2.1.2. are aged 18 years or older at the commencement of the Promotion (subject to clause 2.2 below);


2.1.3. are not a director, officer or employee of the Promoter or any supplier, provider and / or agency associated with the Promotion; and


2.1.4 are not an immediate family member (spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin) of any of the people referred to in clause 2.1.3,


("Eligible Entrants").


2.2 Individuals under the age of 18 years may enter the Promotion, provided that such individuals:


2.2.1 have the permission of a parent or guardian to enter the Promotion; and


2.2.2 otherwise satisfy all other eligibility criteria in clause 2.1 above.



3.1. The Promotion commences on 17 January 2022 at 10:00am Australian Eastern Time ("AET") and concludes on 30 January 2022 at 8:00pm AET (“the Promotion Period”).

3.2. To enter the Promotion, Eligible Entrants must, during the Promotion Period:

3.2.1. scan the QR code displayed at the QUAY store front situated at the Australian Open using their mobile phone;

3.2.2. submit their name, email address and mobile number via the giveaway entry form; and

3.2.3. consent to receive direct marketing communication, including by email and SMS, from the Promoter.

3.4. Entry is limited to 1 entry per person. The authorised account holder of the email address and mobile number provided to enter the Promotion is deemed to be the entrant.

3.5. The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.


3.6. An entry that is incomplete, incomprehensible or otherwise fails to comply with these Terms and Conditions is invalid.  Errors and omissions may be accepted at the Promoter's discretion.


3.7. The Promoter's decision to disqualify an entry is final and no correspondence will be entered into.



4.1. After completing the steps in clause 3.2 above, an Eligible Entrant who has entered the Promotion during the Promotion Period will be directed to the digital "Spin the Wheel" ("Wheel") accessible on the Eligible Entrant's mobile phone and will be eligible to electronically spin the Wheel once.  Winners will be randomly chosen  depending on where the Wheel lands.


4.2. The prizes for the Promotion are as follows:


4.2.1. if the Wheel lands on the segment that says ‘Free Pair of Sunglasses’, the Eligible Entrant will win a free pair of sunglasses to be selected from the Noosa, PSA and Nightfall styles that form part of the Quay / Australian Open branded range that are available at the Quay store at time of redemption ("Major Prize"); or


4.2.2. if the Wheel lands on any other segment that is not ‘Free Pair of Sunglasses’, the Eligible Entrant will win a consolation prize being an exclusive discount offer of an amount specified in the segment the Wheel lands on which is redeemable on quayaustralia.com.au or in the Quay store at the Australian Open (see clause 6.1 below) ("Consolation Prize"),


(together, the "Prize").


4.3. Winners of a Prize ("Prize Recipient") will be notified immediately of the Prize they have won via the Dynamic Yield Spin the Wheel App.

4.4. Eligible Entrants can only enter in their own name. The Promoter reserves the right, at any time, in its sole discretion, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any Eligible Entrant whom the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper conduct calculated to jeopardise fair and proper conduct of the Promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.



5.1. Winners of a Consolation Prize will be provided with a code that is redeemable for purchases of a Quay product made at the Quay store at the Australian Open or on quayaustralia.com.au. The code will be displayed on the screen with prompts notifying the Prize Recipient to screenshot and save the code. The code must be redeemed in store by 7:45PM on 30 January 2022 or on quayaustralia.com.au by 11:59PM on 31 January 2022. 


5.2. Winners of a Major Prize must show the Quay retail staff their mobile screen to redeem their free pair of sunglasses at the Quay store at the Australian Open. .


5.3. As a condition of claiming the Prize, each Prize Recipient must:


              5.3.1. accept these Terms and Conditions;


5.3.2. consent to the Promoter using the Prize Recipient's name, likeness, image and/or voice (including photographs and audio and visual recordings of the same) in any media for an unlimited period without remuneration in connection with the Promotion, the Promoter and for the promotion of any products manufactured, distributed and/or supplied by the Promoter;


5.3.3. participate and co-operate as required in all marketing activities relating to the Promotion, including but not limited to being interviewed and photographed;


5.3.4. sign any legal release and indemnity as may be reasonably required by the Promoter.



6.1.  The Prize details are as follows:

The Major Prize is a free pair of Quay sunglasses from the Noosa, PSA and Nightfall styles that form part of the Quay / Australian Open branded range available at the Quay store (odds of winning are 1 in 20).

The RRP of a pair of Quay sunglasses is approximately $85 (including GST).

The Consolation Prizes are redeemable vouchers in the following amounts:

(a)     15% off any Quay purchase;

(b)     20% off any Quay purchase;

(c)     25% off any Quay purchase; or

(d)     Buy One, Get one Free

The code must be redeemed in store by 7:45PM on 30 January 2022 or on quayaustralia.com.au by 11:59PM on 31 January 2022

The value of the voucher won.

6.2. Prize values are based on the recommended retail prices as at 22 Dec 2021. The Promoter accepts no responsibility for change in Prize values between now and the date that a Prize Recipient claims the Prize. If, for any reason, any of the Prizes (or any part of them) are unavailable or out of stock, the Promoter reserves the right to replace them with a prize of similar value and/or specification.

6.3. Prize Recipients accept the Prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from their Prize. Prize Recipients should seek advice from the Australian Tax Office or their own taxation adviser or independent financial adviser in relation to their receipt of a Prize.

6.4. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be redeemed for cash.




7.1. If for any reason the Promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion subject to any written directions under applicable legislation..

7.2. Except for any liability that cannot by law be excluded, the Promoter and its related entities (including its respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms; (e) any tax liability incurred by any Prize Recipient; (f) use/taking of the Prize; and (g) the Promotion.


7.3. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth) or similar consumer protection laws in the states and territories of Australia (”Non-Excludable Guarantees").




8.1. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects your personal information so that it may process your entry, administer this Promotion and contact you regarding information on products or services that may be of interest to you which may include sending you direct marketing communications, including by email and SMS.

8.2. Each Eligible Entrant agrees that the Promoters or its agents may do the following:

8.2.1. transfer personal information confidentially to the Promoters or other organisations that provide services in relation to the Promotion;

8.2.2. disclose personal information to any government authorities or agencies; and/or; 

8.2.3. publish the winners’ names as required under applicable law.


8.3. The Promoter will use and handle your personal information as set out in its Privacy Policy, which can be viewed at https://www.quayaustralia.com.au/pages/privacy-policy. The Privacy Policy set outs how you may access, update or correct your personal information, or make a privacy complaint.
